Teenage accused facing three counts of sexual assault and one count of choking. Client acquitted of all charges
An allegation of sexual assault against a romantic partner is one of the most stressful events a person can face, that is particularly the case if it arises in the already fraught teenage years. For the young person we defended in Leduc recently, that stress was relieved when the Complainant finally admitted at trial that she had made up her allegations because she was angry at the Accused. Rigorous cross-examination revealed many inconsistencies in the young woman’s evidence as well as the implausibility of her account of events. When it was put to her directly that she had fabricated the allegation that anything happened without her consent she agreed. Shortly thereafter, the Crown invited the Court to dismiss the charges and the Court happily agreed.
