Client was charged with one count of Second Degree Murder. Deceased has been stabbed multiple times at a house party. 3 witnesses testified to seeing client stab the deceased multiple times and deceased’s blood was found on clothing worn by client. Defence argued that crown witnesses were unreliable and the physical evidence did not prove the guilt of the accused.
Held: Client found not guilty.
The Court found the Crown witnesses to be grossly unreliable and the knife that caused the fatal blow was not connect by DNA to the accused.
