Upheld minimum fine and conditional discharge for impaired driving and evading police as a result of Charter breaches by police upon arresting client. Client suffered a broken rib and collapsed lung in altercation. Supreme Court held that the statutory sentencing scheme is broad enough to allow for a significantly reduced sentence for constitutional breaches that impact on the individual accused, and that in exceptional circumstances, the Charter may also allow for a reduction of a minimum sentence.
