Accused pleaded guilty to two counts of dangerous driving causing bodily harm. Accused proceeded through a city intersection at a very high rate of speed (in excess of 100 km/hr) and struck the complainant’s vehicle that was making a left turn. 28 year old accused with no record who was remorseful. Injuries included a broken arm, and an injured diaphragm that required emergency surgery.
Held: 4 months jail.
There was an “extended” driving pattern, and the injuries caused were relatively serious, albeit the injuries did not have long lasting effects. Bosco, 2016 BCCA 55 followed: “driving is a privilege that can wreak great havoc when it is exercised recklessly.” 5 year driving prohibition imposed.
