Trial on charge of breach of a common law peace bond. Accused originally charged with publishing defamatory libel, contrary to s. 301 CC. Accused entered into a peace bond with a condition that any social media postings be “civil and temperate.” Accused then charged with breaching that condition.
Held: Convicted.
Accused’s argument that the peace bond was invalid given that some courts have struck down s. 301 CC, rejected. Accused was represented by counsel at the time the peace bond was entered into, and is bound by the conditions notwithstanding that “she now regrets that course of action.”
